HUBER HEIGHTS — The legal battle between Huber Heights and Clark County which delayed the construction of Buc-ee’s is being dismissed, according to Mayor Jeff Gore.
The lawsuit, which was over the rights to service the gas station’s water and sewage, will be dismissed. The Huber Heights City Council and Clark County approved a new agreement earlier this week.
“On Monday evening the 9th, the Huber Heights City Council approved a new agreement with Clark County regarding the water and sewer service to Buc-ee’s and Old Dominion. This morning the 11th, the Clark County commissioners also approved the agreement. A dismissal of the current legal case will be filed by the end of the week. Construction should resume immediately. AES is currently onsite rerouting the power lines to make way for the construction of the building,” Mayor Jeff Gore said on social media.
The lawsuit was filed in 2023, slowing down the construction at the site, but didn’t down the excitement people are feeling in the community.
“Cincinnati has the Bengals, Cleveland has the Browns, Huber Heights have Buc-ee’s” Ron Fritz said.
Ron and Sonia Fritz run a YouTube channel and have been documenting the Huber Heights construction process with vlogs.
“Right now, we haven’t seen a whole lot of progress in the last couple of weeks and I think it’s due to the lawsuit over the water and sewage,” Ron said. “But there’s a lot of piping out there for the drainage and the fuel tanks arrived.”
